Legal Advocacy for Workplace Harassment and POSH Cases

I want to share a real story about a nursing intern at a government hospital. Her senior, the technician she worked under, would physically harass her after work hours. When she reported it to the POSH committee, they dismissed her case, saying they were short-staffed and couldn't afford to lose the technician. This is the reality many women face, but your career cannot be ruined for speaking up. I am here to ensure that does not happen.
Harassment isn't always obvious. I've seen cases where private company committees try to protect their employees by telling the woman "you're just thinking wrong." They will ask for proof when someone stares at you or touches you inappropriately. If you don't give in to their demands, they retaliate by giving you odd work hours or shifting you to a completely different department. This is also harassment, and we can fight it.
Many victims are silenced because they believe they need a witness or hard proof. This is not true. Even if a sexual harassment incident happened five years ago and you have no evidence, your own statement is powerful enough to build a case. The truth will come out during the legal process.
If you are facing sexual harassment, you must take action. First, use self defense. Then, file a complaint with your workplace's Internal Complaints Committee (ICC), where your identity is kept confidential. If you feel you are not getting justice, file a police complaint. Do not spare the person who wronged you. It is your duty to get them punished, not just for yourself, but to protect other women from them.

In many private companies, when a woman files an FIR, we find the internal committee did nothing. They blame the victim, questioning her for talking on the phone at night. Your personal life is not a justification for harassment. A male colleague has no right to demand the same intimacy you share with your family or fiancé.

Most private company Internal Complaints Committees (IC) are designed to protect the company, not you. They often use tactics like citing 'staff shortages' to dismiss complaints or gaslighting you about your personal life to silence your voice. Your statement is powerful evidence. Do not let them make you believe that you need a video or witness for your claim to be valid. If the internal process is compromised, we bypass the company and file an FIR. Do not let them ruin your career for speaking the truth.

Why Private Committees Fail
Working as an advocate on multiple POSH committees, I see the pattern. Private firms often prioritize their own workforce stability over your safety. They will ask you for 'proof' of things that happen behind closed doors. They will question your character to protect the senior who is a 'valuable asset.'
The Path to Justice
- Assessment: We determine if your issue falls under the Sexual Harassment of Women at Workplace Act, 2013.
- Strategy: We don't just file a complaint. We prepare you for the Internal Committee (IC) hearings, draft your statements to withstand cross-examination, and audit the IC for bias.
- Escalation: If the IC fails, or if they demonstrate clear bias, we do not waste time. We go straight to the police to file an FIR.
Your Statement is Evidence
Many women think they can't fight because they have no witnesses. This is a myth. Your testimony is the primary evidence in a harassment case. The law is designed to hear the victim.
