Navigating Modern Relationships & Legal Realities in India
Relationship laws are shifting rapidly. Whether you are in a live-in arrangement or facing issues with a broken promise, you need to understand your legal standing before things get complicated.
**Are live-in relationships legal in India?** Yes, any two consenting adults can live together, even if one is married. There is no penal provision to stop this, and the police cannot interfere or take action against you.
**Is it a crime for a married person to be in a live-in relationship?** No. The Delhi High Court recently ruled that if a married person is living with someone else, it is not a criminal offense.
**Can an adult woman live with a married man?** An MP High Court ruling observed that no law in India can stop an adult woman from living with a married man. The man's first wife can only file a case for bigamy if he marries the second time.
**Consensual relationship with a married man is not exploitation.** The Delhi High Court quashed an FIR, ruling that an educated woman who knowingly enters a relationship with a married man cannot later claim she was exploited or raped.
**Are prenuptial agreements (prenups) valid in India?** No, prenups are not legally valid. However, you can sign a Memorandum of Understanding (MOU) before marriage to outline terms, which can be helpful in case of future disputes.
**Can you file a case against your spouse's lover?** You cannot file a criminal case. However, the Supreme Court has allowed for filing a civil suit for damages, seeking compensation for alienating your spouse's affection.
**Why does a wife with an affair still get maintenance?** Under Section 125 CrPC, a single instance of adultery is not enough to deny maintenance. The law requires proof that the wife is "living in adultery," which means a continuous relationship.
**Law on extramarital affairs and child legitimacy.** I explain that even if a wife has an affair, any child born during the marriage is legally presumed to be the husband's. Courts rarely allow a DNA test to challenge this.
**Emotional affair is not adultery: MP High Court.** A court ruled that a wife loving another man without a physical relationship does not constitute adultery. This highlights the specific legal definition of adultery.
**A shocking case of a false murder charge.** A man was jailed for two years for murdering his wife, only to find her alive and living with her boyfriend after he got out on bail. This shows how the system can fail.

Under the new Bharatiya Nyaya Sanita, specifically Section 69, a broken promise to marry carries serious penal consequences. Likewise, the courts do not view consent given while intoxicated as valid, and this is a common trap leading to severe criminal charges. Before you take the next step in your personal life, you need to understand the legal paper trail you are creating.

The 'Promise to Marry' Trap
Under the new Bharatiya Nyaya Sanita (BNS) Section 69, there is a specific provision for situations where a physical relationship is established on the promise of marriage. If that promise is broken, it can now lead to a jail term of up to 10 years. This is not just a social issue anymore; it is a serious criminal liability that men must navigate carefully.
Consent and Intoxication
Many disputes arise from casual settings where alcohol is involved. Legally, the court can view consent given under the influence of alcohol as 'invalid consent.' If a partner later claims they were not in a fit state to agree, you could face charges of rape. This is a recurring issue in my practice—what starts as a casual evening can turn into a legal nightmare.
Live-in Relationships & Adultery
While live-in relationships are legal for consenting adults, the absence of a marriage certificate does not mean you are immune to the law. Similarly, while adultery is no longer a crime, it remains a critical factor in civil matters like maintenance and custody. Section 125 CrPC regarding maintenance is clear: single instances of adultery might be ignored, but 'living in continuous adultery' is a ground that changes how courts calculate alimony.
Protecting Your Interests
Prenuptial agreements are not legally binding in India, but a Memorandum of Understanding (MOU) can clarify intentions. Do not sign anything blindly, and do not rely on verbal assurances.
