Legal Evidence and Courtroom Tactics
In court, stories change, but facts do not. Learn how to legally collect, preserve, and present crucial evidence like WhatsApp chats, call recordings, and official records to strengthen your case.
**Three ways to win a case.** The most important thing is to have evidence. People can change their stories, but evidence does not. I always suggest focusing on creating and preserving your evidence.
**Using WhatsApp chats as evidence.** Yes, WhatsApp chats are admissible in court. I explain the need for a Section 65B certificate under the Indian Evidence Act to submit electronic records properly.
**How to prove an extramarital affair with photos or videos.** Simply producing a screenshot is not enough, as the other party can claim it's morphed. You must produce the original device or get official records from the social media company.
**Phone recordings are admissible evidence.** The Allahabad High Court has clarified that a recorded phone conversation is a valid piece of evidence, even if it was obtained illegally. However, obtaining it illegally might lead to other legal issues for you.
**How to get call detail records (CDR) and tower location.** I explain the legal procedures for obtaining call records in criminal and civil cases, using applications under Section 91 CrPC or Order 16 Rule 6 of the CPC.
**The best strategy when the other party lies in court.** Matrimonial cases are full of misleading facts. Instead of just filing a Section 340 application within the same case, I explain the strategy of filing a separate case for perjury to put real pressure on the other side.
About Evidence & Courtroom Tactics
In court, people often change their stories, but evidence remains constant. I help clients legally secure WhatsApp chats, call recordings, and call detail records to build a case that holds up. Crucially, I guide you on filing the necessary Section 65B certificate for digital evidence; without this, even your strongest proof can be rejected by the judge.
Building Your Case with Evidence
Many litigants lose because they assume that having the 'truth' is enough. In court, you need to prove it. Whether it is a matrimonial dispute or a criminal matter, your approach to evidence gathering determines the outcome.
Digital Evidence & WhatsApp
People often ask if WhatsApp chats are admissible. The answer is yes, but only if they are formatted correctly. You must support these records with a Section 65B certificate under the Indian Evidence Act. I help clients navigate this process to ensure your digital records stand up to cross-examination.
Call Recordings & Tower Locations
Recently, the Allahabad High Court confirmed that recorded phone conversations are valid evidence, even if obtained without the other party's explicit consent. However, you must be careful with how you obtain them to avoid counter-cases. If you need Call Detail Records (CDR) or tower locations, we use specific legal tools like:
- Section 91 CrPC Applications: For criminal matters.
- Order 16 Rule 6 CPC: For civil and matrimonial proceedings.
Dealing with Perjury (Section 340)
Matrimonial cases in India are often filled with misleading facts. If you catch your spouse lying in court, do not just file a Section 340 application within the existing case, as it often gets ignored or buried in files. The most effective strategy is often to file a separate perjury proceeding. This creates a fresh, distinct legal challenge that forces the other party to answer for their dishonesty, often leading them to withdraw false claims or settle.
I don't offer vague advice. I tell you exactly what papers to file and which strategies will put pressure on the opposition.
