Domestic violence is not limited to physical harm. It also includes emotional abuse, mental torture, financial abuse like not providing maintenance, and threats or blackmail related to dowry demands.

On India News, I explained that many women do not realize they are victims of domestic violence. Verbal abuse, humiliation, taunts, and discrimination are all forms of domestic violence under the law.

I was honored to be invited as a speaker for 'Project Shakti', a seminar on the elimination of violence against women. Spreading awareness is the first step towards creating a safer society.

About Domestic Violence: Know the Law

The biggest mistake I see is waiting until the situation becomes unbearable to start collecting evidence. Whether it is financial abuse or mental harassment, start documenting everything—chats, recordings, and dates of incidents—from day one. This documentation is the foundation of your case and will be critical if you decide to file a complaint under the DV Act.

Many people believe domestic violence requires physical injury. In the courtroom, however, I see the full reality every day. Section 12 of the Protection of Women from Domestic Violence Act covers much more than assault. If you are facing systematic verbal abuse, your access to finances is being controlled, or you are being threatened or blackmailed in a shared household, the law provides a pathway for protection.

Why Early Documentation Matters

When I advise clients, I always emphasize that your case is only as strong as your evidence. If you are experiencing harassment, do not delete those messages or ignore the patterns. Keep a record of:

  • Financial Abuse: Proof of denied maintenance or unauthorized control over your bank accounts.
  • Verbal/Emotional Abuse: Saved chats, call recordings, or witness testimonies of humiliation.
  • Threats: Any messages or incidents where you felt intimidated or blackmailed.

Addressing the Reality of False Cases

I am a strong advocate for genuine victims. However, I also believe in the integrity of the law. I frequently represent clients facing 498A harassment and false DV claims. If you are being falsely accused, do not panic. My role is to help you build a robust defense by tracking financials and proving the inconsistencies in the allegations. Justice should protect the innocent on both sides of the gender divide.
