Never simply ask 'Why don't you work?' in court. That is a wasted question. Instead, focus on specific, verifiable facts—like her past employment history, educational qualifications, or transferable skills like tailoring. Force her to justify why these skills aren't being used, rather than just stating she cannot find work. This shifts the burden back to her to prove financial dependency.

Cross-examination is the most critical stage of a contested divorce or maintenance case. This is your chance to expose contradictions, uncover hidden income, and dismantle false allegations. If you walk into that witness box without a roadmap, you are letting the other side control the narrative.
Challenging Maintenance Claims
Many wives claim they are unemployed or lack the skills to work to secure higher maintenance. My strategy is to never accept this at face value. Instead of letting her say she cannot work, ask questions that expose her capacity:
- Documented Skills: Ask if she has done any courses or has practical skills like teaching, tailoring, or computer operations.
- Previous History: If she worked before marriage, demand details on why she quit. Did she resign? Was there a termination letter? Where is the proof?
- The 'Help' Strategy: If she claims she cannot work due to childcare, offer to take custody of the child. This puts the responsibility on her. If she refuses, it weakens her argument that she is solely tied down by motherhood.
Defending Against False Allegations
If there are allegations that you prevented her from studying or working, do not get emotional. Use evidence to refute these claims:
- Verification: Ask about her educational status at the time of marriage. If she wasn't enrolled in a course, the claim that you stopped her is demonstrably false.
- RTI and Evidence: Use RTI to get salary data or official documents that contradict her testimony. You must act as your own investigator—get photos of her working or evidence of her running a private tuition center if you suspect she is earning in cash.
Remember, the court looks at facts, not feelings. Your goal isn't just to talk; it is to present evidence that proves she is misleading the judge.
