About Divorce & Family Law
Real Talk on Family Law
Sometimes, life flips and suddenly you’re stuck in messy family disputes. I’ve seen good people get dragged into jhoothe case (false cases) and live scared of courts or police. But darne ki zaroorat nahi hai (there’s no need to be afraid). If you know the right kanooni jaankari (legal info), you can fight back.
Strategy Over Emotion
Just telling the truth won’t win you a contested divorce case. Strategy matters more. I’ll show you how to gather strong evidence and how to use it. Never walk into court empty-handed.
- Mutual Consent Divorce: Fastest way, but not always simple. Supreme Court sometimes lets you skip the 6-month wait in special cases.
- Contested Divorce Advice: You don’t need your spouse’s signature. Court can give ex-parte divorce even if one party is absent. No need to pay alimony before the decree.
Money Fights: Maintenance & Alimony
Courts look at facts, not feelings. If you’re fighting for alimony calculation tips, prove her income, show all your own expenses, and understand when the law says the wife can’t claim maintenance (like cases of adultery or desertion).
Child Custody Strategy
Fathers have rights too. I often advise dads to let the mom take custody only if she legally gives up maintenance claims. And no, a dad taking his own kid isn’t kidnapping.
Shield Against False Cases
Scared of 498A or DV? Supreme Court says police can’t arrest you instantly in dowry cases - they must give notice first. If your family lives separately, they shouldn’t be dragged into DV cases. Once their names are cleared, defamation suits are possible.
Settlements: Be Smart
Never trust informal panchayat settlements. They rarely stand in court. Always finalize divorce with a proper decree, and never hand over cash outside legal channels.
