India's real estate sector is booming, but homebuyers still face many challenges. I believe the Real Estate (Regulation and Development) Act, 2016 (RERA) was a crucial step in creating a robust framework to protect buyers and resolve disputes.
If you have a grievance, you have several options. Under Section 31 of RERA, you can file a complaint for issues like delays or compensation. You can also approach consumer forums, but the Supreme Court has clarified you must choose one forum, not both.
Before rushing to court, it is important to understand the issue and explore other options. Many industries, like banking and telecom, have regulatory authorities and ombudsman schemes that can offer redressal without litigation.
Sending a formal legal notice is often a required first step before filing a lawsuit. This is especially true in cases of breach of contract, property disputes, or consumer matters, and it can sometimes lead to a resolution without going to court.
The key takeaway is that homebuyers have multiple avenues to resolve disputes, whether through RERA, consumer forums, or insolvency proceedings. Understanding your rights under these legal frameworks is crucial to protecting your investment.

About My Work & Philosophy
Whether I am reviewing a 30-year property title chain or explaining Section 31 of RERA to students, my process is designed to identify risks before they become a lawsuit. If you have booked a flat, you shouldn't need a law degree to understand your agreement. I look for the hidden clauses builders bury in the fine print—the ones that lock your capital or waive your rights before you even get possession.
My philosophy is built on prevention. In my experience across Delhi NCR, most real estate disputes, whether it is a delayed possession or a faulty title, could have been avoided with a simple, rigorous check before signing. I treat law as a tool for common people, not just a system for courtrooms.
Why Due Diligence Matters
Before you put your life savings into a home, you need to be sure about what you are buying. I do not just look at the sale deed. My process includes:
- 30-Year Title Trace: verifying the mother deed to the current sale deed.
- Encumbrance Search: checking for existing mortgages or court stays.
- Physical Inspection: identifying risks like high-tension lines or construction deviations that documents often hide.
Handling Builder Disputes
When problems arise, knowing the law changes everything. Under RERA, you have specific protections. Whether you are dealing with a builder who promises 'paper possession' without an Occupancy Certificate or one who has ignored your complaints about structural defects, there is a path forward. I focus on actionable steps—legal notices, RERA complaints, or consumer forum filings—to get your refund or interest.
Making Law Accessible
I believe the courtroom should be a last resort. My work with law students and my legal advisory sessions focus on the same goal: making you aware of your rights. When you understand your rights, you stop being a victim of complex jargon and start making informed decisions.
