Winning a legal battle is not just about having the truth on your side, but about proving it the right way. I help you navigate court procedures and secure vital evidence like CDR and digital chats to strengthen your case.

Call Detail Records (CDR) can be crucial evidence. I explain the three legal ways to obtain them for your case: by filing an application with the Investigating Officer in a police case, filing a Section 91 CrPC application before a magistrate, or using Order 16 Rule 6 of the CPC in a civil case.

Using WhatsApp chats as evidence is common, but they can be easily denied. To make your evidence stronger, I recommend deleting the contact's name so their phone number is visible in the screenshot. This makes it much harder for the other party to disown the conversation in court.

About Evidence & Court Procedure: What You Need to Know

Many people lose their case because their digital evidence is dismissed. For instance, just taking a screenshot of a WhatsApp chat is often not enough because the other party can easily deny it. A simple trick is to delete their saved contact name so their phone number appears clearly in the screenshot. It is a small step, but it makes the conversation significantly harder to disown in front of a judge.

Understanding Your Evidence

Legal fights can get messy, and your evidence is the only thing that speaks for you when you are not there. Whether it is a divorce case, a property dispute, or a 498A defense, the court relies on what you can document.

How to Access Call Records (CDR)

If you need call detail records for a case, there are specific legal ways to get them. Do not rely on casual requests. Depending on your situation, we use these methods:

  • Police Investigation: If you have an active complaint, we file an application with the Investigating Officer (IO).
  • Criminal Trials: We file a Section 91 CrPC application before the magistrate to request the court to order the production of documents.
  • Civil Cases: We use Order 16 Rule 6 of the CPC to request the civil judge to summon the records.

Why Digital Evidence is Tricky

In today's time, most disputes happen over WhatsApp, emails, or call logs. While these are permissible in court, they are also easy to challenge. The opposing party might claim the phone was not theirs or that the screenshot is morphed.

My approach is to help you prepare these documents so they hold weight. I guide you on preserving call logs, understanding tower location data, and drafting your affidavits correctly so you do not face technical objections during the trial.

We operate primarily from the Dwarka Court Complex, and I assist clients across Delhi NCR. If you are worried about the validity of your evidence or need to understand the procedural requirements of your case, let us sit down for a consultation. It is better to have your documents in order before the first hearing than to scramble for them later.
