About Tax & GST Advocacy
My approach to tax matters isn't just about filing papers, it is about challenging the interpretation of the authorities. When representing clients in GST registration cancellation cases, I focus on identifying procedural lapses in the show-cause notices issued by the department. I do not just ask for relief, I compel the authorities to reconsider the legal standing of their orders in the Delhi High Court.
Beyond the paperwork
Tax law is not just about numbers, it is about the right to conduct business without unnecessary harassment. While many taxpayers turn to CAs for tax matters, my practice specifically focuses on the legal challenges that arise when disputes escalate to the Income Tax Appellate Tribunal (ITAT) or the High Court. I believe that legal representation is critical when your case requires an interpretation of the law, not just a calculation of tax liability.
Challenging GST decisions
I have successfully represented petitioners in the Delhi High Court against the Commissioner of Central Tax Appeals, specifically in matters involving the cancellation of GST registrations. My process involves a deep dive into the show-cause notice to see if the department followed due process. Often, the cancellation of a registration is based on a rigid interpretation of the law that ignores the practical realities of the taxpayer. When I step in, I challenge these orders at the judicial level to ensure my clients get their registrations restored.
ITAT and litigation
I am actively involved in matters before the ITAT, including challenging orders from the National Faceless Appeal Centre. Whether the issue is cash deposits during the demonetization period or complex service tax notices, my goal is to frame the legal narrative in a way that aligns with binding precedents. It is not always an easy fight, but it is necessary. I mentor juniors to handle the drafting because juniors ki practice chal jaaye, and this allows me to keep my focus entirely on the courtroom strategy. If you are facing a tax or GST issue that has hit a dead end, let us look at the legal grounds for a breakthrough. 🧿
