Initial Insolvency Consultation
Session Scope
- Format: In-person meeting at Noida Sector 62 or Video Conference via Zoom/Google Meet.
- Duration: 60 minutes with the lead counsel or senior associate.
- Document Review: Scan of unpaid invoices, demand letters, or builder buyer agreements to establish valid debt.
Legal Assessment
- Threshold Check: Verifying if the claim meets the mandatory Rs 1 Crore default limit for corporate debtors.
- Limitation Check: Ensuring the debt falls within the 3 year limitation period.
- Roadmap: Verbal advisory on choosing between NCLT, RERA, or MSME Samadhan routes.
Section 8 Demand Notice Drafting
Drafting & Compliance
- Statutory Forms: Preparation of Form 3 (Demand Notice) and Form 4 (Application) as per strict IBC rules.
- Calculations: Detailed computation of principal debt and applicable interest to ensure accuracy.
- Legal Review: Senior attorney check to eliminate technical loopholes or dispute grounds.
Execution
- Physical Service: Dispatch via Speed Post or Registered Post to the debtor's registered address.
- Digital Service: Official service via email to the company Directors.
- Tracking: Compilation of delivery reports and tracking receipts required for evidence in court.
Homebuyer Claim Filing (Form CA)
Claim Preparation
- Doc Compilation: Collation of Allotment Letters, Builder Buyer Agreements, and payment receipts.
- Valuation: Calculation of claim value including principal and interest (Time Value of Money) at 8% or SBI MCLR.
- Affidavit: Drafting and notarization of the Affidavit in Support required for the claim.
Submission Process
- Filing: Submission of the claim to the Interim Resolution Professional (IRP).
- Verification: Handling queries raised by the IRP during the verification stage.
- Outcome: Sharing the final list of creditors confirming the inclusion of the claim.
Full NCLT Petition Representation
Drafting & Filing
- Petition: Comprehensive drafting of the Section 7 (Financial) or Section 9 (Operational) application.
- Scrutiny: Curing all registry defects and removing office objections to ensure the case is listed.
- Paperwork: Printing, binding, and physical filing of 3 sets of heavy paper-books at the NCLT Bench.
Court Representation
- Appearances: Counsel presence for all hearings from the first motion up to the Admission Order.
- Arguments: Arguing on maintainability, existence of debt, and default before the bench.
- Reporting: Updates on court orders and case status after every hearing.
