If your bank account has been frozen, do not panic. Under Section 102 of the CrPC, a police officer can only freeze an account if it is directly linked to an alleged crime. We can often approach the Magistrate under Section 451 or 457 to argue for de-freezing, provided we follow the right procedural steps. The law favors those who act quickly and know where to look.
Dealing with Frozen Bank Accounts
An unexpected freeze on your bank account is a serious matter, but it is not the end of your financial freedom. The police can freeze an account if it is suspected of containing proceeds of crime, but this action must be supported by valid legal grounds under Section 102 of the Code of Criminal Procedure (CrPC). If you are not the accused, or if the freeze is arbitrary, we can move for a release of these funds by filing an application under Section 451 or 457 of the CrPC. In some instances, we may also invoke the writ jurisdiction of the High Court, citing the violation of your right to livelihood under Article 21.
