About Securing Every Child's Admission
Most schools rely on fear. When they demand Aadhaar cards or deny admission to EWS students, they often count on you walking away. Don't. Before you spend on legal fees, we first check if the school is violating the Delhi School Education Act or the RTE Act. Often, a well-drafted legal notice sent on a senior advocate's letterhead is enough to make a school principal reconsider their decision and grant the admission.
Understanding Your Rights
Many private schools in Delhi operate under the assumption that parents are unaware of the law. They often deny admission citing a lack of documents, school transfers, or simple bias against EWS students. This is shoshan (exploitation). The law is clear: under the Right to Education Act and various Supreme Court directives, no recognized school can deny admission to a child simply because of administrative hurdles they have invented.
The Path to Admission
If you have been denied a seat, do not lose hope. My process focuses on escalating the pressure systematically:
- Direct Communication: We start by engaging with the school administration directly. Often, pointing out the specific legal provisions they are violating makes them back down.
- Legal Notice: If the school remains stubborn, I issue a formal legal notice. This is a critical step that establishes a paper trail. It puts the school on formal notice of litigation, which many institutions want to avoid.
- High Court Petition: If the notice is ignored, the next step is filing a yachika (writ petition) in the Delhi High Court. This is where I argue for the rights of your child to ensure they are not left out of the classroom.
Common Hurdles I Address
- EWS Admission Denial: Refusal to accept students under the reserved category.
- Illegal Fee Demands: Schools asking for prohibited fees or donations.
- Document Restrictions: Denial of admission due to minor discrepancies in birth certificates or address proof.
- Transfer Certificate (TC) Issues: Schools withholding TCs due to fee disputes, which is illegal.
