About Pre-Litigation & Mediation Strategy
Pre-litigation is about taking control of the process before it enters the courtroom. Whether you have received a notice or are worried about police involvement, I send a formal 'Invitation to Mediate' to the other party to open a dialogue. This single step often prevents a conflict from becoming a long-drawn legal battle.
Most people believe a legal notice guarantees years of court drama. It does not. When a dispute begins, time is your biggest asset. Once a case reaches the police or a judge, you lose control over the timeline and the costs. I use mediation to regain that control.
My Mediation Strategy
My approach is built on removing the drama and keeping the focus on your peace of mind:
- Initial Assessment: We deep-dive into the conflict to identify real leverage points.
- The Invitation: I draft and send a formal 'Invitation to Mediate' to the opposing party. This shifts the dynamic from confrontation to a solution-based conversation.
- Structured Sessions: We conduct up to two joint mediation sessions. These take place either in my Dwarka chamber or via video conference for your convenience.
- Binding Closure: We draft a Memorandum of Understanding (MoU) or a Settlement Agreement. If police matters are involved, I handle the formal intimation to the Investigating Officer to close the files.
Is Your Case Eligible?
If you are dealing with a compoundable criminal matter, we can often seek the court's permission to resolve it via compromise under Section 320 CrPC. This requires careful drafting and arguing before a judge to ensure the agreement sticks. If you are stuck in a cycle of police visits or threats of an FIR, acting now is the only way to break the pattern. You do not need to fight every battle; you just need to win the right ones.
